Terms and Conditions

These terms apply when you use vesela.ca, design custom lithophane products, upload photos, or place an order with Vesela Decor in Canada.

Custom-made orders

Every lithophane is made to your specifications after you place and pay for an order.

  • Single lithophane plates and multi-photo lithophane cubes
  • Size, frame color, quantity, and gift options you select at checkout
  • Production begins after your order is confirmed and paid

Your photos & previews

You upload your own images; we use them to build a preview and produce your piece.

  • Accepted formats include JPEG, PNG, WebP, and GIF within site limits
  • On-screen previews are a guide, not an exact guarantee of the finished product
  • You are responsible for image choice, cropping, and how it will read as a lithophane

Shipping & delivery

We ship to destinations offered at checkout, with rates and carriers shown before you pay.

  • Live shipping quotes where available (for example Canada Post)
  • Processing and dispatch times are estimates, not guaranteed delivery dates
  • Tracking is provided when your order ships, when available from the carrier

1. Introduction and Acceptance

Welcome to Vesela Decor. By browsing vesela.ca, using our design tools, uploading photos, or placing an order, you agree to these Terms and Conditions. If you do not agree, please do not use the site or place an order.

These terms work together with our Privacy Policy. Where something is not covered here, we will act reasonably and in line with applicable Canadian law.

2. Products and Services

Vesela Decor sells custom lithophane products made from photos you provide. Our storefront may include lithophane panels, lithophane lamps, lithophane cubes, photo-based decor, and related accessories, depending on what is offered on the site at the time of your order.

You customize your product online—choosing photos, size, frame color where applicable, quantity, and other options shown at checkout. We then 3D print and finish your personalized item for delivery.

3. Custom-Made Products

Unless we clearly state otherwise for a specific product, items are made to order for you. They are not pre-made stock sitting on a shelf. Because of that, each order is tied to your chosen photos, options, and shipping details.

Production generally starts after your payment is successfully processed and your order details are confirmed. That is why review before checkout matters, and why returns and refunds are limited once production has begun (see section 11).

4. Photo Uploads and Content Rights

You keep ownership of the photos and other content you upload. By submitting content for an order, you confirm that you have the right to use it for this purpose and you grant Vesela Decor a limited license to use, store, process, and reproduce that content only as needed to:

  • Generate previews and production files for your order
  • Manufacture, fulfill, and support your order
  • Communicate with you about your order if needed

Do not upload content you do not own or do not have permission to use, including copyrighted images or personal photos of others without consent where required.

5. Prohibited Uploaded Content

You may not upload or submit content that is illegal, infringing, harassing, hateful, exploitative, or otherwise inappropriate. Examples include:

  • Material that violates someone else's intellectual property or privacy rights
  • Explicit sexual content involving minors, or non-consensual intimate imagery
  • Content that promotes violence, discrimination, or unlawful activity
  • Files that are corrupted, misleading, or submitted to abuse our systems

We may refuse, cancel, or report orders that involve prohibited content, and we are not obligated to produce items we reasonably believe violate these rules.

6. Orders and Your Responsibilities

Before you pay, please carefully review your order. You are responsible for:

  • The photos you upload, including quality, cropping, and subject choice
  • Product type, size, frame color, and quantity
  • Gift notes, delivery notes, and any text you enter (spelling and wording)
  • Your name, email, phone (if provided), and full shipping address
  • Your shipping and delivery selection at checkout

Once payment is completed, changes may not be possible if production has already started. Contact us promptly if you notice an error—we will help where we reasonably can.

7. Production Time and Delays

Lithophane pieces take time to print and finish. Any processing, production, or delivery timelines shown on the site or at checkout are estimates, not guaranteed dates.

Delays can happen because of order volume, material availability, equipment maintenance, carrier delays, weather, holidays, or other events outside our reasonable control. We will do our best to keep you informed when a significant delay affects your order.

8. Product Appearance and Previews

The on-screen preview helps you visualize your lithophane, but the finished product may look different. Differences can happen because of:

  • Original photo quality, resolution, contrast, and lighting
  • How the image translates into a 3D lithophane surface
  • Material, thickness, and our 3D printing process
  • Hand finishing and custom production variation
  • Your monitor, phone screen, or room lighting when viewing previews

By placing an order, you understand that minor variation is normal for custom, handmade-style production and is not necessarily a defect.

9. Pricing, Payment, Taxes, and Currency

  • Prices are shown in Canadian dollars (CAD) unless we state otherwise
  • Your final total includes product price, shipping, and applicable taxes as shown at checkout
  • Payments are processed securely through Stripe; card details are handled by Stripe, not stored on our servers
  • We may correct obvious pricing or typographical errors before or after an order when necessary

If payment fails or is reversed, we may pause or cancel fulfillment until the matter is resolved.

10. Shipping and Delivery

We ship to the countries and regions available in checkout at the time of your order. Shipping options, costs, and delivery estimates are shown before you pay. Where available, we use carriers such as Canada Post and provide tracking when your order ships.

You are responsible for providing a complete and accurate delivery address. Risk of loss or damage during transit generally passes to you according to the carrier's terms once the package is handed to the carrier, except where applicable law requires otherwise.

If a package is returned to us because of an incorrect address, failed delivery attempts, or refusal, we will contact you about reshipment or other options. Additional shipping charges may apply.

11. Returns, Refunds, and Cancellations

Because our products are custom-made from your photos and choices, they generally cannot be returned for a change of mind once production has started. If you need to cancel, contact us as soon as possible—we will review requests received before production begins on a case-by-case basis.

If your item arrives damaged, defective, or materially different from what we agreed to produce due to our error, contact us within a reasonable time with your order details and photos of the issue. We may offer a repair, replacement, partial refund, or refund depending on the situation. We do not guarantee outcomes in advance; each case is reviewed fairly.

Nothing in these terms limits rights you may have under applicable consumer protection laws that cannot be waived.

12. Intellectual Property

The Vesela Decor name, branding, website design, text, graphics, and other site content (excluding your uploads) are owned by or licensed to Vesela Decor. You may not copy, scrape, or misuse our branding or site content without permission.

Our production methods, templates, and internal tools remain our intellectual property. Purchasing a product does not give you rights to our business processes or website code.

13. Privacy

Personal information and uploaded photos are handled as described in our Privacy Policy. Please read that policy to understand what we collect, how we use it, and how to contact us about privacy questions.

14. Accounts

You can place orders without creating an account. If sign-in or account features are available now or added later, you are responsible for keeping your login credentials secure and for activity under your account.

Saved cart designs may be stored in your browser on your device so you can continue later. That is separate from a customer account. We may update account-related terms if we introduce new account features.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Vesela Decor is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or products, including loss of profits, data, or goodwill.

Our total liability for any claim related to an order is limited to the amount you paid us for that order, except where applicable law does not allow that limitation.

These limits do not affect non-waivable rights you may have under Canadian consumer protection laws.

16. Website Availability and Errors

We aim to keep vesela.ca available and accurate, but the site is provided on an "as is" and "as available" basis. Temporary outages, maintenance, or technical issues may occur.

We may update product listings, pricing, shipping options, or site features without notice. If we discover an obvious error in pricing or order information, we may correct it and contact you before fulfilling the order where appropriate.

17. Changes to These Terms

We may update these Terms and Conditions from time to time. The "Last updated" date at the top of this page shows when they were last revised. Continued use of the site or placement of new orders after changes are posted means you accept the updated terms, to the extent permitted by law.

18. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute will be handled in the courts or forums located in British Columbia, unless applicable law requires otherwise.
